Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and FoxFish LLC ("we", "us", "our"), the provider of the FoxFish service (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

FoxFish is a web application that helps educators generate quizzes, flashcards, and related teaching materials, and to share them with their students.

2. Acceptance and authority

By using the Service you confirm that you are of legal age and, if using the Service on behalf of an organisation, that you have authority to bind that organisation to these Terms.

3. Accounts

You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You must not:

  • Use the Service unlawfully, fraudulently, or to send spam.
  • Infringe intellectual property, privacy, or other rights of others.
  • Upload malware, attempt to bypass security, probe, or scrape the Service.
  • Resell, redistribute, reverse engineer, or circumvent technical limits.
  • Use the Service to generate illegal content, hate speech, or sexual content involving minors.

You are responsible for the prompts you submit, for verifying the accuracy of AI-generated outputs before using them, and for having the rights to any content you upload.

5. Intellectual property

We retain all rights, title, and interest in the Service, including software, documentation, and branding. You retain ownership of content you upload, and you grant us a limited licence to host and process that content solely to provide the Service.

6. Payment and subscriptions

Payment processing is handled by Stripe, Inc.. By making a purchase, you agree to Stripe's payment terms in addition to these Terms. We do not store full payment card details on our servers.

Paid plans renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account, after which access continues until the end of the current paid period.

7. Service level and warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. To the fullest extent permitted by law, we disclaim all implied warranties.

8. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid for the Service in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where the law does not allow it.

9. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends; you can export your content for a reasonable period before deletion.

10. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction where FoxFish LLC resides, without regard to conflict of laws principles.

12. Changes

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after a change constitutes acceptance.
